<\/strong><\/p>\n2.1. The Client has read the contents of these Terms and Conditions and accepts the applicability of these Terms and Conditions to the Agreement with Travel Detective.
2.2. These General Terms and Conditions apply to all agreements to provide the service and\/or product by Travel Detective, as well as to all (legal) acts, which reasonably precede them.
2.3. In addition to these general terms and conditions of sale, additional terms and conditions such as special promotional terms and conditions may apply to certain services and\/or products, whether or not during a specific period, only if explicitly stated. Should there be any differences between the supplementary conditions and these general terms and conditions of sale, then, in principle, the provisions of the supplementary conditions will prevail over these general terms and conditions, unless otherwise stipulated.
2.4. If the Client refers to its general (purchase) conditions, these conditions of the client do not apply unless expressly agreed to in writing by Travel Detective.
2.5. In case of conflict between Travel Detective’s oral statements and Travel Detective’s written statements, Travel Detective’s written statements will prevail.
2.6. In the event any provision of this Agreement is held invalid, illegal or unenforceable for any reason whatsoever, the remaining provisions hereof shall not be affected. Should an individual provision of this Agreement be or become affected in such a way, the Parties shall attempt to find amicably a new replacing provision corresponding as much as possible to the affected one.
2.7. Travel Detective reserves the right to amend these terms and conditions at any time. Travel Detective shall, at its discretion, determine which products and\/or services will be provided and to what extent. Limitations, extensions and modifications to these products and\/or services are permitted at any time.<\/p>\n

3. Realization of the Agreement<\/h2>\n

3.1. The agreement with Travel Detective is concluded if Travel Detective accepts the client’s offer in writing or in text form (order confirmation) or dispatches the ordered goods (shipping confirmation) within 5 days of receiving the client’s order. If Travel Detective does not issue a statement of acceptance within this period, the client’s order is not accepted.
3.2. Travel Detective is entitled to carry out (or have carried out) a due diligence investigation, including a creditworthiness investigation. If the investigation reveals risks that Travel Detective does not reasonably wish to accept, for which Travel Detective will provide the Client with a statement of the reason(s) upon written request, Travel Detective may impose restrictions and\/or further obligations, or at Travel Detective’s option, hold the Client liable for the costs arising therefrom, if the agreement cannot be entered into or has to be terminated as a result.
3.3. Client may use additional services offered by Travel Detective. These general terms and conditions apply to these additional services unless otherwise indicated in the product description of the relevant additional service. Additional terms and conditions may also apply to additional services.
3.4. For security reasons, orders are no longer accessible via the internet unless the client has created an account.<\/p>\n

4. Fees<\/h2>\n
<\/p>\n
4.1. The Client shall be liable for the fees according to the agreement agreed upon rates or by other written agreement. Travel Detective shall be binding in determining the amounts due, unless it is demonstrated by the Client that such data is incorrect.
4.2. Offers in brochure material, price quotations and quotations from Travel Detective constitute an invitation to the client to make an offer to the client to enter into an Agreement with Travel Detective. Travel Detective is therefore not bound to do so, unless this has been unambiguously recorded in writing by Travel Detective. If in any case an offer, quotation or offer is to be regarded as an offer despite the provisions of the previous sentence, such offer is non-binding and may be revoked or amended by Travel Detective at any time.
4.3. Offers are valid only during the specified promotional period and while stocks last.
4.4. The sale price is in Euros and is exclusive of any legally required disposal contribution and exclusive of any shipping or delivery costs.
4.5. Obvious (writing) errors in price or description of a product can always be corrected by Travel Detective. If, however, the Client decided to enter into an Agreement on that basis, he may cancel this Agreement within fourteen (14) days of Travel Detective making the (writing) error in question known.<\/p>\n

5. Payments<\/h2>\n
<\/p>\n
5.1. Travel Detective has the right to pre-invoice amounts owed by Client under this Agreement.
5.2. The Client shall pay the purchase price in full prior to delivery.
5.3. If Travel Detective specifies in the Agreement or additional conditions that payment after delivery is possible, the amounts owed by the Client must be paid within 30 days after the Agreement is concluded to the bank account specified by Travel Detective.
5.4. Travel Detective may set a maximum limit on the total amount of monthly payments made after delivery as mentioned in paragraph 3 of this article.
5.5. After the payment term has expired, which is more than 14 days after the invoice date, the Client is legally in default without further notice of default being required. In that case, Travel Detective is entitled to charge the extrajudicial collection costs incurred by it. These collection costs amount to a maximum of: 15% on outstanding amounts up to \u20ac2,500; 10% on the next \u20ac2,500; and 5% on the next \u20ac5,000, with a minimum of \u20ac40, excluding VAT.
5.6. The Client is not entitled to offset the amounts owed to Travel Detective.
5.7. Objections to the amount of an invoice, a detected defect, or a discrepancy in delivery, quantities, or specifications do not suspend the payment obligation.
5.8. The Client is obligated to promptly report any inaccuracies and\/or changes in the provided or stated payment information to Travel Detective.<\/p>\n

6. Retention of Title<\/h2>\n
<\/p>\n
6.1. All Products delivered by Travel Detective under the Agreement remain the property of Travel Detective until the Client has fully met all obligations under the Agreement(s) concluded with Travel Detective, including but not limited to the purchase price, any surcharges owed under these Terms or the Agreement, interest, taxes, costs, and damages.
6.2. Products delivered by Travel Detective that are subject to the retention of title under paragraph 1 may not be resold and may never be used as a means of payment. The Client is not authorized to pledge or otherwise encumber the Products subject to retention of title.
6.3. The Client must always do everything that can reasonably be expected of them to safeguard the ownership rights of Travel Detective.
6.4. If third parties seize the Products delivered under retention of title, seek to establish rights on them, or assert claims on them, or if bankruptcy or another circumstance occurs that prevents the Client from freely disposing of their assets, the Client is obligated to immediately notify Travel Detective and, at their own expense, return the Products that still belong to Travel Detective to Travel Detective.
6.5. In the event that Travel Detective wishes to exercise its ownership rights as stipulated in this article, the Client hereby grants unconditional and irrevocable permission in advance to Travel Detective and third parties designated by Travel Detective to enter all locations where Travel Detective’s property is located and to repossess those Products.<\/p>\n

7. Quotes<\/h2>\n
<\/strong><\/p>\n7.1. All quotations issued by Travel Detective by name are valid for 7 (seven) days from the date of the quotation, unless otherwise stated in the quotation.
7.2. If a quoted product, service or component of a product goes out of Travel Detective’s range and is therefore no longer available, Travel Detective reserves the right to remove this product or component from the quotation or to offer an equivalent alternative to it. If the Client has already concluded an Agreement with Travel Detective based on the quotation in question and the change proposed by Travel Detective is substantial, the Client has the right to dissolve the Agreement.<\/p>\n

8. Advertising<\/h2>\n
<\/strong><\/p>\n8.1. The Client may advertise its product or service through Travel Detective’s platform.
8.2. Travel Detective reserves the right to refuse an advertisement, without further explanation.
8.3. Travel Detective shall not be liable for any indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage relating to, in connection with, or otherwise arising out of the use of the Services, even if Travel Detective has been advised of the possibility of such damages.
8.4. Travel Detective shall determine the order of advertising and its form.
8.5. Travel Detective can never be held liable or be required to do anything as a result of any communication, agreements and actions of a User towards another User. The Client agrees that the entire risk arising from the use of the Services, and any service or product requested in relation thereto, shall be entirely at the Client’s expense.
8.6. Travel Detective bears no responsibility for its representations on the Platform or otherwise, and provides information on an “as is” basis, including (but not limited to) the exclusion of warranties as to entitlement to (proprietary) rights, satisfactory quality, availability of the Services, fitness for a particular purpose and non-infringement of proprietary or third party rights. In particular, Travel Detective does not warrant:
a) that the information on the Platform is accurate, complete, appropriate, current and not unlawful, including information provided by Users;
b) that the Platform will operate uninterrupted and free from (deliberate) interference by third parties;
c) that third parties will not use the Platform and\/or the systems of Travel Detective unlawfully.<\/p>\n

9. Correct Information<\/h2>\n
<\/strong><\/p>\n9.1. In order to use the Services, the client must provide personal and business information, such as name, address, residence, and contact information, as well as information about what you are looking for or want to offer. You agree to always provide complete, accurate, non-misleading and recent information and to continually verify that the information known to Travel Detective is true, complete and recent. If you fail to do so then Travel Detective has the right to terminate the agreement with you.
9.2. In special cases, Travel Detective may request the client to provide additional information, or to verify information known to Travel Detective. The client must comply with such a request, regardless of the reason for the request and also if Travel Detective does not wish to provide a reason for this (yet). Travel Detective may deny the client access to or use of the Services, if or for as long as you do not provide the requested information, without being liable for any (consequential) damages.
9.3. In case of violation of the foregoing, the client shall be liable to compensate Travel Detective for any damage incurred by Travel Detective and the client shall indemnify Travel Detective against claims by third parties (including: other Users) in connection with your violation of this section.<\/p>\n

10. Nuisance for third parties<\/h2>\n
<\/strong><\/p>\n10.1. Client agrees to comply with all applicable laws when Client uses the Services, and Client may only use the Services for lawful purposes.
10.2. Client shall not cause a nuisance, annoyance, inconvenience or property damage to others while using the Services.<\/p>\n

11. The Advertising Review Process<\/h2>\n
11.1. Travel Detective’s advertising review system relies primarily on personally to check whether the advertisement complies with Travel Detective’s advertising policies. The process is usually completed within 48 hours, although it may take longer in some cases. During this review, the status of the advertisement will be In Review. Additionally, advertisements may be reviewed again, including after they are live.
11.2. The Advertising Review System reviews advertisements for violations of our advertising policies. This review process may include the specific components of an advertisement, such as images, video, text and targeting information, quality of the image, as well as other information.
11.3. If a violation is found at any point in the review process, the advertisement will be rejected.
11.4. Advertisements always remain subject to review and re-review at all times, and may be rejected for violation of our policies at any time. It is the client’s responsibility to understand and comply with Travel Detective’s advertising policy.
11.5. Beyond enforcing Travel Detective’s policies on individual advertisements, violations of Travel Detective’s terms and policies may result in further enforcement actions, such as disabling advertising accounts, pages, Business Managers and\/or individual user accounts. Disabled accounts, pages or users cannot run advertisements and advertisers may be ineligible to advertise.
11.6. If an advertisement is rejected, the client may create a new advertisement or revise their advertisement to comply with Travel Detective’s advertising policies. These advertisements will be treated as new advertisements and will be reviewed by Travel Detective’s advertising review system.
11.7. If the client believes the advertisement was incorrectly rejected, the client can request a review of the decision by Travel Detective.<\/p>\n

12. Prohibited Content Advertisements<\/h2>\n
<\/strong><\/p>\n12.1. Advertisements must not constitute, facilitate, or promote illegal products, services or activities. Advertisements targeted to minors must not promote products, services, or content that are inappropriate, illegal, or unsafe, or that exploit, mislead, or exert undue pressure on the age groups targeted.
12.2. Ads must not discriminate or encourage discrimination against people based on personal attributes such as race, ethnicity, colour, national origin, religion, age, sex, sexual orientation, gender identity, family status, disability, medical or genetic condition.
12.3. Ads must not promote the sale or use of tobacco products and related paraphernalia. Advertisements must not promote electronic cigarettes, vaporizers, or any other products that simulate smoking.
12.4. Ads must not promote the sale or use of illicit or recreational drugs, or other unsafe substances, products or supplements, as determined by Meta in its sole discretion.
12.5. Ads must not promote the sale or use of weapons, ammunition, or explosives. This includes ads for weapon modification accessories.

12.7. Ads must not contain adult content. This includes nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative.

12.9. Ads must not contain shocking, sensational, or excessively violent content.
12.10. Ads must not contain content that asserts or implies personal attributes. This includes direct or indirect assertions or implications about a person\u2019s race, ethnicity, religion, beliefs, age, sexual orientation or practices, gender identity, disability, physical or mental health (including medical condition), vulnerable financial status, voting status, membership in a trade union, criminal record, or name.
12.11. Travel Detective prohibits ads that include claims debunked by third-party fact checkers or, in certain circumstances, claims debunked by organizations with particular expertise. Advertisers that repeatedly post information deemed to be false may have restrictions placed on their ability to advertise on Travel Detective.
12.12. Ads must not contain content that exploits crises or controversial political or social issues for commercial purposes.
12.13. Ads must not direct people to non-functional landing pages. This includes landing page content that interferes with a person\u2019s ability to navigate away from the page.
12.14. Ads may not promote products or services that are designed to enable a user to engage in cheating or deceitful practices.
12.15. Ads must not contain profanity or bad grammar and punctuation. Symbols, numbers and letters must be used properly without the intention of circumventing our ad review process or other enforcement systems.
12.16. Ads must not contain images that portray non-existent functionality. This includes imagery that replicates play buttons, notifications, or checkboxes, as well as ads containing features that do not work, such as multiple choice options in the ad creative itself.
12.17. Ads may not promote payday loans, pay check advances, bail bonds, or any short-term loans intended to cover someone’s expenses until their next payday. Short term loan refers to a loan of 90 days or less.
12.18. Ads promoting income opportunities must fully describe the associated product or business model, and must not promote business models offering quick compensation for little investment, including multilevel marketing opportunities.
12.19. Ads may not promote penny auctions, bidding fee auctions, or other similar business models.
12.20. Ads must not contain deceptive, false, or misleading claims like those relating to the effectiveness or characteristics of a product or service, including misleading health, employment or weight-loss claims that set unrealistic expectations for users.
12.21. Ads must not contain spyware, malware, or any software that results in an unexpected or deceptive experience. This includes links to sites containing these products.
12.22. Ads must not promote products, services, schemes or offers using deceptive or misleading practices, including those meant to scam people out of money or personal information.
12.23. Ads must not use tactics intended to circumvent our ad review process or other enforcement systems. This includes techniques that attempt to disguise the ad’s content or destination page.
12.24. Ads must not promote financial products and services that are frequently associated with misleading or deceptive promotional practices.
12.25. Ads must not promote the sale of human body parts or fluids.
12.26. Ads must not contain claims that a person or group of people are a threat to the physical safety, health, or survival of others on the basis of race, ethnicity, national origin, religious affiliation, sexual orientation, caste, sex, gender, gender identity, serious disease, disability, or immigration status. Ads must not promote violent or dehumanizing speech, statements of inferiority, or contempt or disgust based on protected characteristics or immigration status.
12.27. Ads must not contain praise, support, or representation of individuals or groups with ties to violence.<\/p>\n

13. Account<\/h2>\n

If the client has an account with Travel Detective, the client is responsible for any activity that occurs under the client’s account or registration, and the client agrees to keep the account username and password confidential at all times. Unless otherwise permitted in writing by Travel Detective, client may only own one account.
13.2. The client may not authorise third parties to use his account and the client may not assign or otherwise transfer his account and\/or registration to any other person or entity without the prior written consent of Travel Detective.<\/p>\n

14. Maintenance and Malfunctions<\/h2>\n

Travel Detective is entitled to (temporarily) put the Website and\/or the App out of operation or to restrict the use of the Website and\/or the App in the event that this is necessary, for example, for maintenance or adjustments, without this giving rise to any right to compensation, even if it appears that Travel Detective has not given notice of this or has done so too late.
14.2. The client acknowledges and accepts that it is possible that the Platform is temporarily out of use, the Services are otherwise inaccessible, or due to technical faults or maintenance do not function properly, or Travel Detective is not accessible, etc. Also in this case, Travel Detective is not liable and no right to compensation arises.<\/p>\n

15. Using the services<\/h2>\n
<\/strong><\/p>\n15.1. The Client must comply with the requirements for reasonable use of the Service and additional services;
15.2. Travel Detective can in no way be held responsible for the proper functioning of the software, hardware, connections, suppliers, clients, customers, other clients, content and security. The use of the services of Travel Detective is in all aspects entirely at the own risk of the client and\/or its customers;
15.3. The client is responsible for all use of his\/her own connection and is therefore responsible for all call charges incurred;
15.4. Travel Detective may provide access codes for certain services. The Client is to protect the access codes against unauthorised use. The Client is responsible for all use made of the access codes. If there is, and\/or if Travel Detective suspects, unauthorised use of the access code, Travel Detective is authorised to block the access codes with immediate effect;
15.5. Travel Detective cannot be held responsible for any call charges and mobile usage costs incurred by the client’s customers.
15.6. Travel Detective does not guarantee that the Services, or any part thereof, will work on certain hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the internet and electronic communication.<\/p>\n

16. Discontinuing services<\/h2>\n
<\/strong><\/p>\n16.1. Travel Detective may discontinue the services offered to the client, without notice of default:
a) in case the client does not comply with the obligations arising from this agreement
b) in case the client has provided incorrect information to Travel Detective.
16.2. The discontinuation may be ended if the client still meets its obligations;

<\/strong><\/p>\n17.1. Travel Detective is not responsible, nor liable, for the content and or operation of the content services.
17.2. Content may be subject to intellectual property rights. The client may only use the content for personal, non-commercial use.
17.3. Travel Detective is entitled to change the content without giving reasons;
17.4. Travel Detective is not responsible, nor liable, for the accessibility of the content services.<\/p>\n

18. Transferring Rights<\/h2>\n
<\/strong><\/p>\n18.1. The client may not transfer the rights arising from this agreement to a third party without written consent.<\/p>\n

19. Delivery<\/h2>\n
<\/strong><\/p>\n19.1. The agreed or specified delivery date or delivery period does not constitute a deadline and is always approximate, unless agreed otherwise in writing. Information provided by Travel Detective via its website, by e-mail, by telephone, in writing or at the office regarding delivery dates or delivery times is in all cases purely indicative;
19.2. Travel Detective is authorised to make partial deliveries;
19.3. If a product and\/or service is no longer available, this will be made known to the Client by telephone or in writing. In such a case, Travel Detective is not obliged to offer the Client a replacement product under the same conditions;
19.4. Travel Detective recommends that the client immediately checks the products and\/or services on delivery for accuracy, completeness and any damage. In this way, Travel Detective can promptly supplement or replace the delivery in case of incomplete or incorrect delivery, or in case of damage to the products delivered.
19.5. Information, images, communications, advertisements, price indications, via the internet, the App, orally, by telephone, email or any other means of communication, regarding all offers and the main characteristics of the products, are displayed or made as accurately as possible. However, Travel Detective does not guarantee that all offers and products are fully in line with the information provided. Minor deviations can in principle not be a reason for compensation and\/or (partial) dissolution.<\/p>\n

20.2. Travel Detective collects and processes personal data of clients and users solely for the purposes of (i) the administration and performance of Agreements concluded with clients, (ii) investigation of defective products and services offered by clients and users (iii) repair of defective products offered by clients, (iv) for Travel Detective’s customer database, all in accordance with the Data Protection Act. If a Client or a user wishes to inspect, correct or have their personal data removed, the client can contact Travel Detective about this using the contact form on this website and Travel Detective will provide the client with all the information required and, if so desired by the client, adjust or remove the data, unless a legal obligation resting with Travel Detective prevents this and provided that the client has attached a copy of their valid identification document to the e-mail in question. 21.3. The use of the “App” is dependent on the services of third parties. Travel Detective assumes no liability for this availability;
21.4. Travel Detective shall not be liable for any indirect damage, consequential damage, trading loss, damage caused by delay, loss of profit, intangible damage, personal injury and damage due to loss of data are excluded from compensation, unless mandatory legal provisions prevent this;

21.10. Travel Detective is always entitled to sue suppliers and other parties involved in the claim for damages and to recover damages suffered by clients from these suppliers and other parties;
21.11. Client shall be liable for all damages suffered by Travel Detective as a result of any breach of this Agreement.
21.12. The Client shall indemnify Travel Detective against claims by third parties for compensation for damage that these third parties might in any way recover from Travel Detective.<\/p>\n [\/et_pb_text][et_pb_text admin_label=”ART 22″ module_id=”TERMS-EN-ART22″ _builder_version=”4.27.0″ _module_preset=”default” text_font=”–et_global_body_font|300|||||||” global_colors_info=”{}” theme_builder_area=”post_content”]<\/p>\n 22. Entering into this Agreement does or shall not result in a transfer of any intellectual property rights belonging to each of the Parties prior to signing of this Agreement.
22.2. Client and\/ or relations of the client are not allowed to copy, produce and\/or distribute the Feel Free 24\/7 formula as mentioned under Article 1 without permission of Travel Detective.
22.3. A direct claimable penalty of 60% of the value of all payments of orders executed by Client is applying to art. 21.1 and 21.2 as a warrant undiminished the rights of fully indemnification of Travel Detective.<\/p>\n [\/et_pb_text][et_pb_text admin_label=”ART 23″ module_id=”TERMS-EN-ART23″ _builder_version=”4.27.0″ _module_preset=”default” text_font=”–et_global_body_font|300|||||||” global_colors_info=”{}” theme_builder_area=”post_content”]<\/p>\n 23. Force Majeure<\/h2>\n23.1. In the event of force majeure on the part of Travel Detective, the Customer is only entitled to compensation from Travel Detective if Travel Detective gains an advantage due to its shortcoming that it would not have had if it had properly fulfilled its obligations. In that case, the Customer is entitled to compensation for their damages up to a maximum of the amount of the advantage gained by Travel Detective.
23.2. Travel Detective may suspend its obligations under the Agreement for the duration of the force majeure.

To the extent that Travel Detective has already partially fulfilled its obligations under the Agreement at the time of the occurrence of the force majeure, or will be able to fulfill them, and the fulfilled or to be fulfilled part has independent value, Travel Detective may invoice the already fulfilled or to be fulfilled part separately. 24.2. The applicability of the Vienna Convention on the International Sale of Goods, the provisions in Book 7 of the Dutch Civil Code, and Articles 6:227b paragraph 1 and 6:227c of the Dutch Civil Code are expressly excluded.
24.3. All disputes arising from offers or Agreements, however named, will be exclusively submitted to the competent court in Utrecht (the Netherlands).
24.4.
